Procedures on Indonesian President and VP Removal from Office

Jakarta, VOI News - After a dynamic meeting, the Ad Hoc committee of the People's Consultative Assembly has come up with Draft Decision of the Indonesian Assembly regarding the Assembly Provisions and Ethics. The draft arranges the procedure to dismiss the president and/or vice president within their time of administration. This matter is arranged in Chapter XVII Article 102-105, which states the following procedure:
 
1. First, the Assembly is obliged to hold a plenary to decide on the House of Rep.'s suggestion to dismiss the president and/or vice president within their administration period. The Assembly must hold the plenary at the latest 30 days after receiving the suggestion.
 
2. The House of Rep.'s suggestion must include a decision from the Constitutional Court that the president and/or VP are proven guilty against the law for state treason, corruption, bribery, or other heavy crimes, or immoral behaviour; and/or proven that the president and/or VP no longer qualify as president and/or VP.
 
3. The Assembly then would invite the president and/or the VP to hear their explanations regarding the suggestion of their dismissal in a plenary meeting of the Assembly.
 
4. If the president and/or VP are not present to state their reasons, then the Assembly will still decide on the suggestion to dismiss the president and/or VP.
 
5. The Assembly's decision for the dismissal of the president and/or VP must be taken within an Assembly plenary with at least three quarters of the total members and must be agreed by at least two thirds of the present members. (kps)
